Continuing to browse this site (swissguardians.com) (hereinafter the “Site”) implies unreserved acceptance of these general terms of use (hereinafter the “GTU”) governing the relationship between Swiss Guardians and any individual or legal entity wishing to access the Site and its services (hereinafter the “User”).
The version of these GTUs currently online is the only one that can be enforced during the entire period of use of the Site and until a new version replaces it. It is therefore up to the User to consult the GTU regularly. Browsing the Site and using all or part of the services after any changes have been made to the GTU will constitute acceptance of these changes.
1. ACCESS TO THE WEBSITE
The Site is accessible free of charge at any location to any User with Internet access.
Access to and use of the Site is strictly for personal use. You undertake not to use this Site and the information or data contained therein for commercial, political or advertising purposes or for any form of commercial solicitation, in particular the sending of unsolicited e-mails.
2. CCONTENT OF THE SITE
Swiss Guardians makes available to Users on the Site a contact form, information concerning the Swiss Guardians brand, the offers and services provided by Swiss Guardians and its news.
Swiss Guardians cannot guarantee that the Site, and more particularly the information contained therein, is free of error or omission. It is therefore the User’s responsibility to use the information available on the Site with discernment.
3. CONTACT FORM
Swiss Guardians makes a contact form available to Users on the Site. It offers Users the possibility of contacting Swiss Guardians to send a request for information (loyalty – press), a partnership proposal or a more general request. It is a channel offered to the User to communicate with Swiss Guardians.
The use of the contact form is free of charge and optional and implies the acceptance by the User of these GTU.
All mandatory fields must be filled in to validate the sending of the contact form and the User must indicate a valid e-mail address.
Validation of the form by the User implies consent to the form, to these T&Cs and to the Privacy Policy, as well as acceptance by the User to receive a reply from Swiss Guardians.
Swiss Guardians reserves the right to respond to the user by the means it deems most appropriate to the situation, which the User accepts.
Access to the contact form is available 7/7, 24/24. However, Swiss Guardians reserves the right to change, modify or suspend, without prior notice, the form for maintenance reasons or for any other reason deemed necessary.
The unavailability of the form does not give the right to any compensation.
4. INTELLECTUAL PROPERTY
The Site, the trademarks, logos and any other distinctive sign of Swiss Guardians or its partners, and any software used on the Site as well as the contents of the Site (i.e., any text, video, photograph or any other information in any format and of any nature whatsoever appearing on the Site) (hereinafter the “Properties”) are the exclusive property of Swiss Guardians or its partners.
The Properties may be protected by copyright, trademark, patent or other intellectual property rights.
It is therefore forbidden to copy, modify, reproduce, distribute, publish, incorporate in any medium, adapt, transfer or assign, license, sublicense, pledge or otherwise transmit in any form the Properties or to reverse engineer or otherwise attempt to gain access to the source codes and/or protocols of the Properties, without the express permission of Swiss Guardians or the rights holder.
Failure to comply with this prohibition constitutes an infringement that may give rise to civil and criminal liability for the infringer.
The fact that Swiss Guardians does not initiate proceedings as soon as it becomes aware of these unauthorized uses does not mean that it accepts the said uses and waives its right to prosecution.
5. SITE MANAGEMENT
For the proper management of the Site, Swiss Guardians may at any time:
• suspend, interrupt or limit access to all or part of the Site, reserve access to the Site, or to certain parts of the Site, to a specific category of Internet user ;
• delete any information that may disrupt the operation of the Site or that contravenes national or international laws or the rules of Netiquette ;
• suspend the Site in order to carry out updates.
6. RESPONSIBILITIES
Swiss Guardians cannot be held responsible for any failure, breakdown, difficulty or interruption in operation, preventing access to the Site or any of its functions.
The equipment you use to connect to the Site is your sole responsibility. You must take all appropriate measures to protect your equipment and your own data, in particular from viral attacks via the Internet. You are also solely responsible for the sites and data you consult.
Swiss Guardians shall not be liable for any legal action taken against you :

• as a result of your failure to comply with these GTU.
Swiss Guardians is not responsible for any damage caused to you, third parties and/or your equipment as a result of your connection to or use of the Site and you waive any claim against Swiss Guardians in this respect.
Should Swiss Guardians be subject to any legal proceedings as a result of your use of the Site, it may seek compensation from you for any damages, sums, awards and costs that may arise from such proceedings.

In any case, any link must be withdrawn on simple request from Swiss Guardians.
Any information accessible via a link to other sites is not under the control of Swiss Guardians, which declines all responsibility for their content.
9. APPLICABLE LAW
Any dispute relating to the interpretation and performance of this GT&C is subject to Swiss law.
